Public collection rules

Empower Bolga, nadační fond, head office: Jiráskova 600, Chrudim IV, 537 01 Chrudim, Czech Republic, ID: 21036080, incorporated in the Foundations Register kept by the Regional Court of Hradec Králové under File N. 573, is an operator of a public collection and website www. empowerbolga.com and www.bolgabags.cz (“the Operator“). 

The Public collection rules (“the Rules”) regulate the relationship between the Operator and a subject (a legal or natural person)  who intends to voluntarily contribute to the public collection. (“the Contributor”) carried out through the website www.bolgabags.cz.  The range of Contributors is not determined beforehand. 

By confirming the order, the Contributor acknowledges that s/he has read and unconditionally agreed to these Rules.

I. Public collection

1. The Operator organises a public collection under Act No. 117/2001 Sb., on public collections, as amended, which has been notified in writing to the Regional Authority for the Pardubice Region and registered under file no. KUPA 4908-2025-5. 
2. The purpose of this public collection is to obtain voluntary monetary contributions for projects whose main purpose is to improve the standard of living of people living in the Bolgatanga area in Northern Ghana. Contributions obtained in the public collection are used primarily to support social housing and employment of local small entrepreneurs - knitters, their families and the wider community (mainly by purchasing goods they produce themselves), to cover the costs of education for local children and students (mainly by purchasing basic school supplies), to support the improvement of the quality and availability of medical care (e.g. by covering the costs of disease screening and subsequent treatment for certain basic illnesses), improving living conditions (e.g. by building sanitary facilities) and increasing the financial literacy of local residents.
3. The collection takes the form of sale of items, with the contribution included in their price. Specifically, these are handmade bags and baskets – so-called Bolga Bags ("Public Collection"). By payment of the price of the selected item ordered via the website www.bolgabags.cz the contributor contributes to the Public Collection. The contribution represents the profit from the sale, i.e., the price after deducting the costs of organising the Public Collection, transport, customs duties, VAT, postage, and administrative fees. The amount of the contribution depends on the specific circumstances of the sale and usually represents 60% or more of the product´s price. 
4. In addition to these Rules, contributions to the Public Collection is governed by Act No. 117/2001 Sb., on public collections, as amended, and Act No. 89/2012 Sb., the Civil Code, as amended. Due to the non-commercial nature of the Operator's activities within the Public Collection, the special legal provisions governing the relationship between entrepreneurs and consumers and the sale of goods in stores do not apply to the relationship between the Contributor and the Operator. 
5. Upon confirmation of the order, a contract for the provision of a contribution to a Public Collection is concluded between the Contributor and the Operator. Based on this contract, the Contributor is obliged to make a contribution to the Public Collection. The Operator is obliged to deliver the ordered item to the Contributor and to use the contribution for the purposes of the Public Collection. Further rights and obligations of the Contributor and the Operator are set out in these Rules. 

II. ORDER AND DELIVERY TERMS AND CONDITIONS

1. When ordering a selected item on the website www.bolgabags.cz, the Contributor shall place the selected item in the shopping cart and continues with the order, filling in the information necessary for the Operator to process the order. 
2. After completion and payment of the order price by the Contributor, the Operator shall dispatch the ordered item to the Contributor as soon as possible after the price has been credited to the Operator's account number 336930009/0300. The amount must be identifiable on the account under the variable symbol generated in the order and sent to the Contributor in the order confirmation. In this case, the Contributor will usually receive the ordered item within 10 working days of the amount being credited to the account. The Operator confirms the order by sending an email with a summary of the order to the Contributor's email address.
3. The ordered item can be delivered in the following ways:
   1. by post – using the services of Zásilkovna, Balíkovna or PPL
   2. personal collection at the address Štěpánkova 89, Chrudim (collection times: Monday and Thursday 2-5 p.m.)
4. Packaging and postage costs for delivery via Zásilkovna and Balíkovna are CZK 99, and CZK 79 for delivery via PPL per a shipment of up to 3 Bolga Bags. (The maximum number of Bolga Bags in one shipment is 3). The fourth and subsequent bags will be sent in another package. Payment fees correspond to the current price list of the Contributor's bank.

III. CONFIRMATION OF THE DONATION

1. The Operator shall send a donation confirmation to all Contributors who express an interest in receiving such confirmation. If interested, the Contributor shall indicate their interest in receiving a donation confirmation in the comments section during the payment process. The confirmation shall be sent by post or email at the beginning of the following calendar year. The Contributor may request a confirmation at any time thereafter, provided that they clearly document their purchase via www.bolgabags.cz. In the case of payment by credit card, the purchase is considered documented only if the Contributor provides, in addition to their identification details, the order number received in the confirmation email for the order in question.
2. Making a contribution to a Public Collection through the purchase of an item on the website www.bolgabags.cz allows the Contributor to deduct the value of the donation as a gratuitous performance from their income tax base, provided that the conditions of Act No. 586/1992 Sb., on income taxes, as amended, are met (the current conditions for deducting a donation from the tax base are set out in Section 15(1) for taxpayers who are natural persons and Section 20(8) of the same Act for taxpayers who are legal entities). The amount of the donation automatically corresponds to the price of the purchased item. 

IV. COMPLAINTS

1. Handling of complaints and the exercise of rights arising from defective performance are governed by Act No. 89/2012 Sb., the Civil Code, as amended. Due to the nature of Public Collections, the sale of items via the website www.bolgabags.cz is not subject to the warranty and other conditions set out in the special provisions of the Civil Code on the sale of goods in stores.
2. The operator points out that all items intended for sale in Public Collections are originals representing the result of creative manual work. As a consequence, each item contains distinctive features, elements of irregularity, uniqueness, and the individual creativity of its creators. If the selected item shows signs of damage that occurred during transport, the Contributor has the right to withdraw from the contract for contribution to the Public Collection and request a refund of the price paid or request a replacement item. The specific method of complaint will be resolved by mutual agreement between the Contributor and the Operator.
3. In the event of a complaint, the Contributor is obliged to inform the Operator without undue delay by email to: info@bolgabags.cz. The email must include the information necessary to trace the order.

V. SECURITY AND PERSONAL DATA PROTECTION

1. The Operator shall handle the Contributor's personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) ("GDPR") and in accordance with Act No. 110/2019 Sb., on the processing of personal data, as amended.
2. All information and data provided by the Contributor to the Operator during the contribution to the Public Collection via an order at www.bolgabags.cz are confidential. The Contributor is obliged to immediately notify the Operator of any changes to personal data that could affect the fulfilment of the order. The Operator is the personal data administrator within the meaning of the GDPR.

VII. FINAL PROVISIONS

1. The rules are published on website: www.bolgabags.cz.

2. The Operator has the right to alter and amend the rules time from time. 

3. The Rules are binding for the Contributor and for the Operator at the time of their wording published at the time of the order placement.
